Terms of Service

By accessing or using ProForms (“the Service”), operated by ProForms (“we,” “us,” or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

• You must be 18 years or older to use this Service.
• You are responsible for maintaining the security of your account and password. ProForms will not be liable for any loss or damage from your failure to secure your account.
• You are responsible for all activity that occurs under your account, including content submitted through forms you create.
• One person or legal entity may maintain no more than one free account.
• You must provide accurate and complete information when creating your account.

ProForms provides a REST API and MCP (Model Context Protocol) server for programmatic access. By using these interfaces, you agree to:

• Authenticate all API requests with a valid API key tied to your account.
• Respect rate limits. Excessive requests may be throttled or temporarily blocked.
• Not reverse-engineer, scrape, or abuse the API beyond its documented functionality.
• Keep your API keys confidential. You are responsible for any actions taken with your keys.

You agree not to use ProForms to:

• Violate any applicable law or regulation.
• Collect personal information without proper consent or in violation of privacy laws (GDPR, CCPA, etc.).
• Send spam, phishing attempts, or misleading content.
• Distribute malware, viruses, or any harmful code through forms or embeds.
• Attempt to gain unauthorized access to other accounts, systems, or networks.
• Use the Service in a way that could damage, disable, or impair our infrastructure.

• Paid plans are billed in advance on a monthly or annual basis and are non-refundable except where required by law.
• All fees are exclusive of taxes, which will be added where applicable.
• We reserve the right to change pricing with 30 days’ notice. Price changes take effect at the start of your next billing cycle.
• Failure to pay may result in suspension or termination of your account.

• You may cancel your account at any time from your dashboard settings. Cancellation takes effect at the end of your current billing period.
• Upon cancellation, your data will be retained for 30 days before permanent deletion. You may export your data during this period.
• We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

You retain all rights to the content you create and submit through ProForms. By using the Service, you grant us a limited license to host, display, and transmit your content solely for the purpose of providing the Service.

The ProForms name, logo, and all related branding are our intellectual property and may not be used without written permission.

To the maximum extent permitted by law, ProForms shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Any disputes arising from these Terms or the Service will first be addressed through good-faith negotiation. If unresolved within 30 days, disputes will be settled through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Utah. You agree to waive any right to a jury trial or class action.

We may modify these Terms at any time. We will provide notice of material changes via email or a prominent notice on the Service. Continued use after changes take effect constitutes acceptance of the new Terms.
